Who is responsible for screening documents submitted as required by law to be employed in the US?If workers submit false documents to work in the US is it a criminal Act?
Yes it is, but currently, it seems only citizens must worry about the consequences for doing so.If workers submit false documents to work in the US is it a criminal Act?
It is an illegal act to submit false documents. The employer is required to accept documentation that on its face appears to be valid, and is not expected to be an expert on documentation or authenticity.





The government is at this time working to enhance its systems for detecting whether people have submitted valid work documentation, and has voluntary and limited programs for verification of status. Only the government can make the determination as to whether someone is actually entitled to work and employers are not permitted to deny work to people who present documentation that appears to be valid.
Yes, to a certain extent the employer is responsible as they are supposed to screen documents present for I-9 purposes. However, when congress passed IRCA1986, they passed laws that were so unenforcable that it is difficult to hold anyone accept extremely blatant violators to the letter of the law. In other words if you show up with some decently manufactured false documents an employer is presumed innocent: if the documents presented look like your five year old made them then you might be held accountable.
It is a felony to use a fake or stolen soc sec #, but illegals are getting around this by stating they did not realize the number belonged to a real person and that the person would be hurt by them using it.

Well according to the new Homeland Security Director, crossing the border illegally is not against the law, so I would deduce that submitting false documents would not be against the law either***************
Yes. I'm not sure who is responsible. I think there are many screening agencies depending on what are of employment is. Regardless, they are probably illegal themselves.
Yes, fraud, and I hope anyone who does this gets the maximum penalty allowed by law.

Well, this is a very good example why the Government should start cracking down on the immigration scams going on in the US. Many immigrants think they are doing things the right way, but they are only left with broken dreams, and they don't know they posses fake documents until someone checks them in the system. President Obama stated that employers should be prosecuted, but that all goes back to these immigration scams, so lets hope they focus on the source, not the employers.
